The Office of Financial Regulation is responsible for the development and/or guidance of particular elements of the foreclosure process including house and receives particular notices and registrations associated with the foreclosure process. Specifically, the Office promotes policies regarding the forms, sequence of documents, and specific processes to be utilized as part of the foreclosure procedure, including, but not limited to:


- the format and content of the Notice of Intent to Foreclose, the design template loss mitigation application, the initial loss mitigation affidavit, the last loss mitigation affidavit, the notification to accompany the order to docket;
- the cost, notification, application and directions for prefile mediation, and a mediation checklist that explains the matters that will be reviewed and thought about in a prefile mediation; and
- the demand kind for postfile mediation, the files and info to be provided by each party to the mediation, and a mediation checklist that explains the matters that will be evaluated and considered in a postfile mediation

.18. Foreclosure Notices and Registrations


The Office administers Maryland's Foreclosure Registration System, a web-based application for submission of the foreclosure-related notices and registrations that are mandated by Maryland law. Specifically, the system enables authorized users to send and/or browse the following foreclosure-related notices and registrations:


- The Notice of Intent to Foreclose is a caution notice to the property owner that a foreclosure action could be filed versus them in court. It should be sent by certified and first-class mail to the homeowner no less than 45 days before a foreclosure action may be submitted in court. Pursuant to Maryland law and guideline, a copy of the Notice of Intent to Foreclose must be digitally sent to the Commissioner through the Foreclosure Registration System within 5 company days of mailing a Notification of Intent to Foreclose. The Commissioner does not accept submissions in any other way. Filing a copy of the Notice of Intent to Foreclosure with the Commissioner must be accomplished before a party is licensed to submit an action to foreclose a mortgage or deed of trust on house. Failure to comply with this requirement will subject a lawbreaker to the enforcement jurisdiction of the Commissioner. Refer to Md. Code Ann., Real Prop. § 7-105.1(c)and COMAR 09.03.12.02.- The Notice of Foreclosure provides particular information relating to home subject to a foreclosure and should be filed within 7 days of the filing of an order to docket or a grievance to foreclose a mortgage or deed of trust on the home. 7-105.2.-The Foreclosed Residential or commercial property Registration is planned to track owner contact details for foreclosed residential or commercial properties between the date of the foreclosure sale and recordation of the deed moving the residential or commercial property to the brand-new owner. The Foreclosed Residential or commercial property Registration includes contact info for the buyer, the party accountable for upkeep of the residential or commercial property, and the entity licensed to accept legal service on behalf of the purchaser, in addition to other relevant info such as whether the residential or commercial property is known to be occupied, the date of the sale, and the date of court ratification. This info is planned, in part, to allow regional governments to attend to concerns connected to the residential or commercial property, such as code enforcement, nuisance reduction, residential or commercial property maintenance, law enforcement, public security, public health, emergency situation services (fire, EMS), to inform public law (i.e. data collection to recognize trends, develop policy actions, etc), and to aid in the collection of pertinent taxes. Within thirty days after a foreclosure sale of house, a foreclosure purchaser will submit a Preliminary Registration ($50 filing charge if timely/$100 filing cost if late) and within one month after a deed transferring title to the house has been recorded, the foreclosure purchaser will send a Final Registration (no filing charge). .14. After Initial Registration, and within 21 service days of a modification, a foreclosure buyer should upgrade its registration with any change in 1) the name and address of the person, including an alternative purchaser, who is authorized to accept legal service for the foreclosure purchaser, 2) if understood, the occupancy/vacancy status of the residential or commercial property, 3) the name, telephone number, and street address of the individual who is accountable for the upkeep of the residential or commercial property, and 4) the status of whether the foreclosure buyer has belongings of the residential or commercial property.


NOTE: Specific notice and registration information in the Foreclosure Registration System is generally confidential and is not public details. Maryland State and City government Officials may be authorized in their official capability to see Notices of Foreclosure or Foreclosed Residential Or Commercial Property Registrations (for their respective jurisdictions only) by developing a Federal government User account in the Foreclosure Registration System. Additionally, a homeowner's association or condominium in which a residential or commercial property in concerns is situated, or a person who owns residential or commercial property on the very same block as a residential or commercial property in question, might ask for from OFR or local jurisdiction specific information related to a Notification of Foreclosure or Foreclosed Residential Or Commercial Property Registration. Except as noted above, OFR is restricted from supplying information regarding specific residential or commercial properties to the general public.
